Why Tort Exists
Lawyers are in the line of work of enforcing our civil laws when a person is hurt without reason. The laws state that we exercise caution in our interactions with one another. If I have a business that invites people onto my property, I have a duty to ensure that the property is reasonably safe so that my customers are not hurt.
Any municipality has the same responsibility, to take steps to make sure that its sidewalks, streets and highways do not pose an unreasonable risk.
When a dangerous situation exists and is known to exist for a sufficient period of time that it could be corrected but is not, the property owner may be responsible if an injury occurs.
It makes sense, and its a law. As a society, we wish people, businesses, and government acting responsibly - to take due care in dealing with others. Tort law is like the golden rule.
